1. Agreement and adult responsibility
By using EverPieces: Train Tracks, you confirm that you are the parent or responsible adult operating the app and that you can agree to these terms. Children may view the app and participate in the physical activity with you, but they should not make purchases or use parent-only features.
If you do not agree, do not use purchase features. Nothing in these Terms limits rights that applicable consumer law does not allow us to limit.
2. What EverPieces: Train Tracks provides
EverPieces: Train Tracks provides guided 3D train track layouts, exact piece lists, closed-loop checks, completion memories, optional photo capture, and a one-time full library purchase that permanently unlocks 43 additional layouts. The five free layouts remain available without a purchase. Physical train tracks, trains, devices, internet access, and third-party services are not included.
We may update, improve, suspend, or retire features for security, legal, technical, or product reasons. Purchased access will be handled consistently with App Store rules and applicable consumer law.
3. Safe physical play
An adult is responsible for selecting age-appropriate wooden track pieces and trains, following the manufacturer's warnings and instructions, inspecting pieces for damage, supervising play, and keeping small parts away from anyone who may swallow them. Stop using damaged pieces and seek appropriate professional help if a part may have been swallowed.
Digital layouts are creative guides, not engineering, structural, medical, or safety advice. Track layouts can contain small, elevated, or unstable arrangements. Use judgment, supervise closely, and keep builds away from stairs, traffic, sleeping areas, pets, and other hazards.
4. Accounts and acceptable use
EverPieces: Train Tracks is designed to work without an account, and your progress and photos stay on the device. You are responsible for your device, your Apple account, and actions taken through them. Do not attempt to bypass purchase controls, interfere with the service, upload unlawful or harmful material, probe security, automate abusive requests, or use the app in a way that violates another person's privacy or intellectual-property rights.
Build photos should show the physical build only. Do not submit a photo containing a person, identifying document, precise-location information, confidential material, or content you do not have the right to process.
5. Purchases, restore, and refunds
The full track library is a one-time, non-consumable in-app purchase made through Apple. It permanently unlocks 43 additional layouts; the five free layouts remain available without a purchase. There is no subscription.
Apple shows the localized price before purchase, and payment is charged to the Apple Account at confirmation. The purchase does not renew and does not expire. Deleting the app does not cancel or refund the purchase, but the full library can be restored with the Apple Account that made it.
Use Restore Purchases with the Apple Account that made the purchase. Restored access depends on Apple's verified transaction record. Prices, taxes, refunds, billing issues, and territory availability are subject to the App Store terms shown at purchase. A refund or revocation can remove the related entitlement as permitted by Apple's rules and applicable law. Family Sharing is not offered at launch.
6. Photos
A photo of a completed layout is optional and stays in app-private device storage. You retain your rights in photos you take. EverPieces does not upload, share, or transmit your photos unless you explicitly choose an operating-system action to save or share a copy.
EverPieces cannot delete copies held by other apps or people. Do not photograph people or identifying or confidential material.
7. EverPieces content and intellectual property
The app, brand, model presentations, text, artwork, software, and other EverPieces materials are owned by the operator or its licensors. Subject to these terms and App Store rules, you receive a personal, limited, non-exclusive, non-transferable license to use the app for family, non-commercial purposes.
Do not copy, sell, publish, scrape, reverse engineer, or create a competing catalogue from protected materials except where applicable law expressly permits it.
8. Suspension, deletion, and availability
You may stop using the app at any time. Deleting the app removes locally stored progress and photos from the device. We may limit or suspend features when reasonably necessary to address abuse, security, legal obligations, provider outages, or violations of these terms. We will preserve non-waivable consumer rights and explain material effects where required.
Services may occasionally be interrupted. Local-first features are designed to remain useful, but we do not promise every device, provider, network, model, or operating-system version will always be available.
9. Disclaimers and limits
To the maximum extent permitted by applicable law, EverPieces is provided on an “as available” basis and does not replace adult supervision or manufacturer safety instructions. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
10. Governing law, changes, and contact
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming. Mandatory local consumer protections and other non-waivable rights continue to apply where required. We may update these Terms as the service changes and will provide reasonable notice of material changes where required.
